General terms and conditions of sale
1) Purpose
These general conditions of sale are intended to define exclusively the conditions under which the products of the company ADBD SARL are sold.
They do not apply to the products of other sellers of the Orizonsmarket platform, it being understood that the company ADBD SARL is a third party in the contractual relationship between these sellers and the buyers.
2) Order
The buyer, who acknowledges having the legal capacity to contract, must first create an account on the Orizonsmarket platform.
At the end of this step, he/she adds to the basket the product he/she wishes to purchase and its quantity.
The products are offered within the limits of available stock.
The photographs of the products represent reality as faithfully as possible, without committing the seller.
The order is confirmed by the buyer from the moment he/she presses the "confirm/validate" button.
The order is confirmed by the seller through a confirmation email sent to the buyer.
The price of the products is displayed including all taxes, except for the shipping costs or those related to the import of the products, and the delivery costs.
3) Payment
The buyer pays the price of the products ordered through the means of payment available on the Orizonsmarket platform.
The price and the value added tax applicable to a sale are those in force at the time of the order.
The sale is deemed to be concluded upon payment of the products.
4) Delivery
ADBD SARL proceeds to the delivery of the products within ... working days for the products intended for Senegal, and .... working days for the products intended for the other countries of the world, as from the payment of these products.
The delivery is assured by the carriers designated by the salesman.
The products are delivered to the place indicated by the purchaser.
The buyer is required to check the contents of the packaging in the presence of the delivery person and the condition of the products.
The discharge affixed on the delivery order by the buyer proves the effectiveness of the delivery.
5) Warranty
The purchasers benefit from the guarantees against the hidden defects, the eviction and all disorders of enjoyment.
6) Order delivery
The buyer is required to take delivery of the products at the place where delivery is to be made and to perform any act likely to enable the seller to fulfil his obligation.
Any reservations on the delivered products must be mentioned on the delivery note.
7) Withdrawal
The buyer does not have a right of withdrawal after a sale.
8) Contestation
The buyer agrees to contest any sale that does not conform to his order within 48 hours of receiving the products.
This dispute is made either by calling ................ or by sending an email to .................
The response of the company ADBD SARL is notified to the buyer in the same way.
In case of justified dispute, the company ADBD SARL proceeds to the replacement or exchange of products within 30 days, except legal exceptions.
The expenses of return of the products are the responsibility of the company ASHOAR SARL.
9) Modification
ADBD SARL reserves the right to modify, at any time, the present general conditions of sale, in particular in the event of legislative or statutory evolution.
The general conditions of sale applicable to an order are those in force at the time of the order.
10) Resolution of the sale
ADBD SARL and the user can implement the resolution of the sale of a product for failure of one of the parties to its obligations.
11) Applicable law
These general conditions of sale are subject to Senegalese law.
12) Settlement of disputes
Disputes arising from these general conditions of sale are settled amicably.
Failing that, they are submitted to the arbitration of the Center for Arbitration, Mediation and Conciliation of Dakar.
